Patrick McStay Believes SDSD Was Wrong To Turn Case Over To FBI

Here are Patrick's reasons why he believes that the Sheriff's Dept is wrong and Joseph and his family's disappearance was caused by foul play:

1) Leaving beloved family pets alone and at risk; one a vulnerable puppy. Not modus operandi to treat family pets in such a manner
2) Out of character for Joseph McStay to abandon established, committed parental relationship with teenage son; Summer also invested in loving relationship with step-son
3) Sudden abandonment of family home renovations with indications the work is to be continued short and long term
4) Leaving house on Feb. 4 at 7:47 p.m., a normal bedtime for McStay children
5) “Oddity of falling out of contact with family and friends”
6) Unknown whereabouts for four days of a family’s life
7) Person’s attempt to download business QuickBooks Pro program on Feb. 8; not initiated by McStays
8) QuickBooks contacted for customer service and download support Feb. 8
9) Future plans made for short term events (birthday party, sister visit); receipt signature at Ross store Feb. 4 considered suspicious by family/friends
10) Withdrawals, via PayPal and email, of considerable amounts Feb. 6; transaction not initiated by the missing McStays. Transfer goes through on Feb. 9, the day the McStays discovered to be missing
11) Bank account transfer initiated 2/15 was not by missing McStays
12) E-Check payment of funds to a gmail account Feb. 18; not initiated by missing McStays
13) Funds transfer request via gmail initiated on Feb. 24; not by missing McStays
14) Request transfer of funds from McStay bank available March 9; not initiated by missing McStays
15) Gmail payment of considerable amount sent to gmail account March 11; not initiated by missing McStays
16) Considerable amount in eCheck payment on March 25; not initiated by missing McStays
17) Another considerable amount on March 25 via eCheck; not initiated by missing McStays. Over $8,000 requested on the same day in two different transactions
18) Attempts by person, not the missing McStays, to withdraw $2,000 from Union Bank OC on March 30. After declined, person attempted again on March 30, May 5, May 21.
19) Attempt to transfer, since withdrawals continue to be declined, a $1,000 transfer on June 1. Seems to indicate someone trying to figure out how to access funds from account in various ways. McStay bank account closed
20) Another two attempts on June 1 to transfer said $1,000 from an alternate McStay bank account; transfer “returned by bank: an invalid bank account number”
21) Password changed June 2
22) No established motive for McStays to voluntarily disappear
23) Threat toward Summer McStay
24) Obsession toward Summer by former relationship
25) Former obsessed person moves close to McStays prior to Feb. 4
26) 3 felons or ex-cons involved in this case
27) Det. Dugal says on January 3, 2011 "I think something bad happened"!
28) Det. Dugal states that whatever happened didn't happen in the US!

Claims from San Diego Sheriff’s Department the McStay adults voluntarily disappeared, taking two children with them:

1 ) Border crossing video
2 ) McStay’s search on internet for children entering Mexico
3 ) Isuzu Trooper found abandoned in parking lot near Mexico border a few hours prior to alleged border crossing
4 ) No obvious signs of foul play
5 ) "To go from a suspicious disappearance to a criminal (activity), we are not there yet”

I Have Moved On – Again


I am moving on, again. I had moved at the end of March and was pretty happy about it, but then came the announcement about the FBI taking the case from the SDSD. Suddenly, my blog lit up again and the traffic was record-breaking. In a 48 hr span, the blog had over 26,000 unique hits from 16 countries, a tribute to the number around the world who have interest in this case.  By Saturday, April 13, the blog was back to the normal 3,000 or so hits per day.

So, time to move on again, but I will be back when something new arises. (Below is my original Moving On post.)

I will continue to moderate my blog. I have to, with over 3,000 page views per day, this blog has gone international and is now 'the place to go for everything McStay.'

I have written a book, offered a $50,000 cash reward from my personal foundation, spent over $17,000 in travel expenses trying to find the family, have donated all the profits from the book, have done over 75 television, radio and newspaper interviews and have given up two years of my life. Was it worth it? Yes. While nothing I have done led to solving this mystery, the case is now front and center internationally as never before and that can only help. Sure, the nut cases following this mystery caused some heartburn, and the resistance to finding the family posed by Mike and Patrick McStay was at best frustrating, at least I still tried. Many of you have also tried. We should all be proud of that, especially because it is more than what any of the extended family members have done.

As I move forward in my life, I wish to thank all the supporters of me, my blog and especially this case.  I have many new friends as a result of my book and look forward to actually meeting some of them in person as I take a long road trip.

It may be 20 years before we learn the fate of the family, or it may be tomorrow. Either way, this chapter in my life has now come to a close as I begin research for my next book.

I will no longer post personal daily entries to my blog without new information. Nor will I conduct interviews on the case. I will also post any new developments that occur, ie, another body found in SoCal, serious sightings, etc.

And, if you, or anyone you know has new information on the family, make sure you email me immediately. I will always be available for new information. I want this solved as much as the rest of you.

Is It Still Possible To Disappear?

Two of the country's most notorious survivalists – the Hermit of North Pond in Maine, and The Mountain Man of Utah, were found and arrested in the last few weeks. And a case of a missing family, the McStay family of southern California, was effectively closed when investigators said the family appears to have gone to Mexico voluntarily.
So is it still possible to "disappear" in 2013?
"Is it more difficult? Yes," said Jim Biesterfeld, a former U.S. army counter-intelligence special agent who teaches private investigations at California State University-Fullerton Jim Biesterfeld. "Impossible? Not even."
For someone to hide away from society, he said, at least two things are essential: self-sufficiency, and desire.
"There are not that many people who want to stay hidden for that long" in solitude," Biesterfeld said. "Most people try to establish new identities."
That's why it's unusual for two cases of solitary survivalists to have been solved in such close succession.
Christopher Knight, 47, also known as The North Pond Hermit, appears to be one of those few who truly wanted to live on his own.
For 27 years, Knight avoided making a campfire for fear of drawing attention to himself. He stole what he needed to survive from campgrounds; in fact, everything he had was stolen except his eyeglasses. If there's not much reason to be found, as in Knight's case, costly police investigations are unlikely. But, eventually, Knight's thefts of food and survival supplies prompted local law enforcement to get involved.
It would take a possible federal criminal violation in addition to a disappearance, such as a fugitive or kidnapping situation, for the FBI to become involved, said FBI special agent Kathy Wright.
"The FBI requires an authorized law enforcement purpose to conduct an investigation," she said. "The mere fact that an adult disappears, is not, on its own, a violation of law."
**So what 'law enforcement purpose to conduct an investigation' is there for the McStays?**
In the end, a surveillance camera set up specifically to catch Knight triggered an alarm when he entered a campground kitchen looking for food, and Knight was arrested.
While technology – such as thermal imaging that detects people by tracking body heat – is helpful in pinpointing a location once a general area is mapped out, investigators haven't abandoned old-fashioned methods. In the case of Troy James Knapp, also known as The Mountain Man in Utah, it was snowshoe tracks that eventually gave him away.
Biesterfeld relies on the old adage of investigators and journalists: Keep It Simple, Stupid. Find out everything you can about the person.
"What was he like as a kid? Did he have mental health issues? Had he ever talked about it before?" Biesterfeld said. "In most cases, people crave human contact. The rare few who do not are the Maine guy and the unabomber" – and, it appears, Utah's Mountain Man.
"He says, 'I don't hate people. I just don't like living with them,'" the Huffington Post quotes him telling Sevier County Sheriff Nathan Sheriff Curtis.
Knapp had been living off the radar since 2004. He caused more disturbances than Knight, sleeping inside other people's cabins and stealing food, camping equipment and guns. But because searchers knew his habits, they were able to discover the snowshoe tracks that led them to him.
Knapp's trial started this week; there are 29 burglary-related felony and misdemeanor charges filed against him.

I Talked To The FBI and Here's What They Said...


We all have questions about the FBI taking over the McStay case. It just doesn't make sense the way this was handled. So I called the FBI to ask my questions.  I spoke for a time to Special Agent Darrell Foxworth with the San Diego Division of the FBI. He was not happy that I called him, nor was he pleased that I asked him a series of questions. It was clear that he was put out that an average citizen would call him and question the FBI or the SDSD and how they have handled this case. But you know what? It is my right to call and ask these questions. At the end of our conversation, he gave me his email address and told me to send him my questions, which I did. Here is the email:

Special Agent Foxworth:

I appreciate your willingness to look at these questions:

1. Why did the FBI take over this case in April of 2013? The boys are the same boys that went missing on Feb.4, 2010. Why didn't the FBI take over in March of 2010 when SDSD detectives stated definitively that the family have voluntarily went to Mexico?

2. Why make this announcement to the general public at all? What is the purpose of telling the public?

3. The SDSD's statement claims that "the consensus is that the family, in all likelihood, traveled into Mexico of their own free will." Whose consensus is this? The SDSD? All law enforcement agencies that have worked on the case? 

I would like to post something to my blog about this regarding your answers and that we have communicated, so please tell me what I can and cannot publish.

I did not hear from Special Agent Foxworth at all yesterday so I sent him a second request. Here is his reply from this afternoon:

Well, we already know that the SDSD will not talk to anyone about this case, and certainly not me, so there is your answer. No none is going to talk. Does the FBI have new information? Only they know and it is a waste of time to speculate. My suggestion would be to move on with your life, check back on my blog and WS when you can and wait until the FBI makes another announcement in the future. It could be tomorrow or next year. Either way, this is the only life we have and do you really want to spend it on this case?

Patrick McStay: Debbie Erp Must Be Stopped


I hate to do this here when this is for my Families Case. But it has been brought to my attention by several people that Debbie Erp is continuing to attack and spread false and incomplete information about me to people through emails and in the background. She is saying false things that are absolutely wrong and incorrect as comments of fact. She has been doing this for almost two years since I cut all contact with her when she started falsely accusing Summer of so many unfounded things and she wouldn't stop. She also did many other things that not only I asked her to stop, there were several others that tried to get her to stop. She came up with information others (definitely more than a few) that told her she was wrong, but again she wouldn't stop with the false information.

Now I know many people think she is a saint and knows so much about my Families Case, but she doesn't know near as much as many others think or they themselves know or can find by searching the web. She does search and find information and she is very good with computers and she has even been accused by several people of hacking. So it's doesn't seems as if it wouldn't be to hard for her to do things we know someone else has done that we know that person has made false and inaccurate statements in the past and had false accounts.

I have at least five or six people who have recently contacted me and sent me emails from Ms. Erp where she is attacking them for being friends with or simply talking with me. I have over 39 emails she sent me in less than about a month or so containing truly disgusting comments, and that was from the past where she harassed and stalked me via my email.

I had to contact FB Security to have her stopped and I threatened to contact the FBI and file "cyber stalking" charges in order to have her stopped. She then tried to file against me with FB which was found baseless. Now she is at it again and she is not only attacking me but she is as I said attacking other people. You can also clearly see how she attacks people on many different sites such as her FB and my Son Michael's FB page. I also believe she comments on other sites under "anonymous" and other names, in my opinion, to hide the facts of what she does and so people will not see the real Debbie Erp.

She has got to stop! So if this continues, I will again file complaints with FB and this time I will go forward with legal charges. I have tried to refrain from doing this because of what she claims of her medical problems. But I now have to believe that she plays on peoples sympathies when she does these things, and so people over look what they know and are not aware of what she does in the background in order for it not to be known. I believe she clearly knows that if it were known what she does to me as a Family member, then what would she do to others that aren't family??

Now if this continues (with the permission of the involved) I will post ALL the emails and vial statements Debbie Erp has sent to me and to the other people she has attacked. I have approximately five or six people she has attacked and I believe there are many more.

So all I say is STOP MS ERP GO AWAY, JUST GO AWAY!!!

Sorry to all of you who think she is a saint or so great but don't know the truth. remember the truth will always ring through. If you don't believe me just go back on these pages and see how many people she has attacked or made derogatory comments to or about, just because she disagreed with them. As you probably know she is and has been for quite some time BANNED from this site for her attacks on me and others.

I think if you doubt me, you should just ask people on all the sites how many of them have received angry attacks from Ms. Erp. I think we all would be shocked if we really new the total number.

Again I'm sorry to have to do this but Ms. Erp is at it again and I have had to put up with her doing this repeatedly for about two years and it's time it STOPPED!

Why Did The FBI Take Over McStay Case?



 Here is the statement that was just issued by the SDSD about turning the case over to the FBI:

SAN DIEGO - "The case of the missing McStay family from Fallbrook has been investigated by the San Diego County Sheriff's Department since they were reported missing in February 2010.

Over the last three years, the Sheriff's Department has conducted an exhaustive missing person investigation in an attempt to locate the family. Hundreds of tips have been investigated without success. Since the case was initiated, we have worked closely with the San Diego Division of the Federal Bureau of Investigation (FBI), as well as other law enforcement agencies. The consensus is the family, in all likelihood, traveled into Mexico of their own free will. There has been no contact or communication from them since February of 2010.

Due to the fact that the family is believed to be out of the country, and because minor children are involved, the primary investigative responsibility for the case is being transferred to the FBI. The FBI is the most appropriate law enforcement agency to continue the investigation since they have significant experience and investigative assets in foreign countries. The Sheriff's Department will continue participating in the investigation in a supporting role.

Anyone with information about this incident is asked to call Crime Stoppers at (888) 580-8477. You can remain anonymous and be eligible for up to a $1,000 reward for information leading to the resolution of the case."

This statement was released by Lt. Glenn Giannantonio, San Diego Sheriff's Homicide Detail (858) 974-2321.

Okay, now that you have read this curious statement, let's try to take this to the next level by asking a series of questions that might shine some light on this new development:

1. Why even announce to the public in the first place that the FBI has taken over the case? What are they staging? They sure made a big deal with the press release, didn't they? What does it matter to you or me if we know the FBI case leader? It doesn't. So, why did the SDSD make this announcement and why so soon after my book and my $50,000 reward?  Was it because of their reasons stated above? I doubt it.

2. Why is the FBI even involved in the first place? It is not illegal for a family of four to suddenly move "out of the country" (according to the above statement) and live off the grid. Cheesy, yes and insensitive to loved ones, but not illegal. So, why the FBI? It is not just about the "boys," it is also about the possible murder of one parent and so now the FBI can get involved to make sure the kids are safe as well as arrest the murderer.

3. Why would the FBI take over just now when the SDSD has maintained for three years that the family "voluntarily" went to Mexico? Why didn't the FBI take over then for the sake of the kids? Answer? Read up on the Gavin Smith case just north of this one up in the San Fernando Valley of SoCal. How did LE act in that "Voluntary Missing" case? Did they tell the truth? Were they upfront with the public?

I believe that the authorities found something and that 'something' now mandates that the FBI take over. Simple as that.

Here is a fun exercise for all followers of the Case. First, watch this VIDEO from NBC7 San Diego shot as Mike McStay gives the reporter a tour of Joseph and Summer's home in March of 2010. Second, examine carefully the pictures on the right hand margin of my homepage that I took of the inside of the same home in 2011. Now, compare the condition of the home and contents. What has changed? Should raise some eyebrows.

• Bashers must identify themselves. I have removed many comments from Anon or initialed posters that bash individuals by name. If you want to criticize someone involved with this case by their given name, then you must also post your given name.The bashed ones need to know the identity of the bashers. This is fair so if you don't want your real name out there, please refrain from any bashing.

Yesterday was the biggest single day for unique visits with over 9,800. The international coverage of the FBI taking over the case is the reason and it has further renewed interest in the case. Why Won't Media Ask Hard Questions?

I originally posted this on March 19, as I was fed up with the media no longer investigating. It seems to me that today's "journalists" are not interested in learning the truth about any story, only printing the regurgitated material.

Now, with the announcement of the SDSD "transferring" the McStay case to the FBI, the media has an awesome opportunity to do some "real" investigating. They should be asking the FBI and the SDSD questions like: Why do this now? Why didn't the FBI take this three years ago? Why even tell the public? What makes you so sure the border crossing tape is the McStays, or are you still 'speculating? Why, Why, Why?

The most recent national post on this development was by Gabriel Falcon with CNN. I know Gabriel and I like him, but once again, our national media has failed. Mr. Falcon, with the resources of CNN at his disposal, has once again posted a regurgitated piece with nothing new. Why is Mr. Falcon and every other journalist afraid to ask the hard questions?

Is the media afraid to ask the hard questions surrounding the McStay case?

Based on the national coverage in the past two weeks, it appears so.

With the release of NO GOOD-BYES, the media now has at their disposal, more evidence that might lead to a resolution in this case than they have ever seen in the public forum since the disappearance on February 4, 2010.


Yet, so far, all national media has chosen to ignore these facts and continue to write their superficial stories in a manner as to 'not offend anyone.' 


What happened to investigative journalism? A possible murder is staring them in the face, and yet they go out of their way to avoid asking the hard questions and actually doing a service for their readers. 


Here's an example of what I mean by "superficial articles." While this article is from the Orange County Register, so far all national media has taken this same route to date. Let me preface this by saying that I know this reporter was only completing the assignment given to him. Any fault here lies with the editors of the Orange County Register.

MICHAEL MCSTAY RESPONDS

Michael McStay, who is mentioned in the book many times, said in an interview that the book is based on speculation and is not accurate.
"He needs to get a fact checker," McStay said. Okay, Michael, please give me some of the facts in the book that you believe are wrong? How about just one?  
"This is not a soap opera, this is real life," he said. "We're holding out that we will see them again one day."  Okay, Michael, if this is the case, why did you withdraw so much of Joseph's money just after he disappeared? If you did see him again one day, would you return all his money?
McStay said he plans to write his own book about the case with Dana Point writer and business owner Tom Blake, who was once married to McStay's mother.
"I just want a true reflection of who Joey and his wife, Summer, are," McStay said. But, Michael, didn't you despise Summer and accuse her of trying to poison Joseph, at least that is what you wrote in numerous emails?

Again, this reporter wrote the story he was assigned to write which is exactly what he did. It was not his place to ask these hard questions, without direction from his editor.
Understand that while I do appreciate this publicity from the OCR and all the other national and regional exposure this case is now receiving or about to receive, it is not enough.
This case is not about me. I have had my fill of being the front person to the sacrifice and exclusion of the McStay family. I am trying my darndest to get the focus of the media off of me and on what really matters here: a missing family.

Why Is There No 48 Hours Show?

Simple. The case has not been solved.

CBS flew me to NYC in February to talk about my involvement as a consultant in a possible 48 Hours show on the missing McStay family.

Here is a pic of me with one of the show's producers and other executive staff. I was treated to a first-class lunch at Porter's Steakhouse in the Time Warner Center across from Central Park.

























If all members of the media were as classy as these ladies, America would be in a much better place.

When in NYC, seeing The Empire State Building is always a must, even when it is so cold your shadow freezes to the sidewalk.

Rick, Why Won't You Release The Documents?



After careful consideration and prayer, I have decided to not release the documents, for five main reasons:

1. Revenge
Part of my motivation for the document dump was to exact revenge on the people who have spent the better part of the past two years defaming, libeling and harassing me, my wife, and even her late husband. Releasing the documents, especially the emails and recorded phone conversations, would have given me some measure of justice against these thugs. But it is still wrong. Romans 12:19 - Do not take revenge, my dear friends, but leave room for God's wrath, for it is written: "It is mine to avenge; I will repay," says the Lord. (I must admit though, that when Debbie Erp went after my wife, it took an immense amount of self-control to not hunt them down and exact my own form of revenge.)

2. The Database
As most know, I was given access to a database of hundreds of personal emails and their attachments, such as tax returns, dental records, notes regarding therapist and CPS investigations, as well as many financial records from the McStays and their business associates. In the months that I was examining these documents, I copied most of them so that I could review while offline, as well as for my own protection. As I had no signed contract with those giving me permission to examine the docs, and in the event they were to suddenly change their minds, I needed to have these documents in my possession to complete the book. The owners of the database have not given me permission to release these documents and I cannot ask them presently because any relationship we had in completing the book together has been severed. What happened? 


While I was in NYC meeting with the producers of 48 Hours last month, I was asked by one of the executives at the meeting if they could view the same documents that I had been given access to, believing that in order to do the show, they would also need to see this database. So, during the meeting, I called my friend, the point person in charge of the database, to ask if the producers of 48 Hours could see the files. When the point person answered the phone, I inadvertently used this person's first name in saying hello. It was an innocent mistake and no one at the table even heard the name. I gave my phone to one of the producers who wanted to ask this person for permission, not knowing or even caring who they were. The point person immediately hung up on the producer. 


The point person then called the others involved with their database and they all began sending me emails calling me a "liar" and the "worst kind of human being" for "outing them to the producers of 48 Hours." But I had not revealed their identities to anyone. These were people who had become my friends. I had spent many, many hours on the phone with them reviewing the database, and then just like that, I was a liar to be discarded. To this day, they have never wanted to hear the truth and we have not spoken since. 


While no one knows their identities, (other than my wife) like so many in this case, they don't trust anyone at anytime, not even each other. They believe everyone involved with this case, and maybe mankind in general, are liars. It's a shame, really. They lost a good friend in me.



3. All or None
The release has to be all the docs or none at all to clearly see the big picture. There are some documents that if released, may hurt innocent people. However, unless they are released, the dump will not paint the complete picture for all to see. In choosing to not hurt the innocent ones by withholding some of the docs, the rest of the release becomes incomplete. I could still release my notes and emails that were not restricted by confidentiality, but they will appear incomplete if not backed up by the original documents. Here's an example: In one series of email conversations, I ask a friend of Summer specific questions about an email between the two of them. She answers in detail and we email back and forth for a week or so. If the original email between the two of them is not attached to my emails, the whole conversation becomes confusing.

4. No Light of Day
Some of the documentation should never see the light of day, especially the more damaging emails from Joseph and Summer (and other family members) that I purposely left out of the book. It wasn't right to include them in the book and so it is not right to release into the public domain either.



5. Documents Won't Solve The Case
Releasing the documents will not solve the case. I am confident that all of this information is already in the hands of law enforcement, and they haven't solved the case, so who are we to think we can? 



So, that's it. I am sorry if this angers or disappoints those who have supported me, but I must stay true to my conscience and what is best for everyone involved. I am not concerned about my credibility taking a hit because the ones making those charges are tormented souls that few pay any attention to. Their opinion of me means nothing to me or anyone else.


I may have changed my mind, but my conscience is clear, and that is what should matter to all of us in everything we do. Rick
